A complaint was received by VDSS Division of Licensing on March 18, 2026,regarding allegations in the area(s) of: RESIDENT CARE AND RELATED SERVICES Number of interviews conducted with residents: 1 Number of interviews conducted with staff: 3 Observations by licensing inspector: The resident who was the subject of the complaint was interviewed in their apartment. The resident was appropriately dressed and groomed. The resident?s apartment had all the required furnishings and a variety of personal belongings were arranged throughout their apartment. Additional Comments/Discussion: The resident who was the subject of the complaint stated they feel safe and that their needs are met. The Acknowledgement of Inspection form was signed and left at the facility for each date of the inspection. A complaint was received by VDSS Division of Licensing on January 26, 2026, regarding allegations in the area(s) of: PERSONNEL; STAFFING AND SUPERVISION; RESIDENT CARE AND RELATED SERVICES; RESIDENT ACCOMMODATIONS AND RELATED PROVISIONS Number of interviews conducted with staff: 3 Additional Comments/Discussion: At the time of the on-site inspection, one resident who was involved in the resident-on-resident altercation was no longer living at the facility. The other resident was unable to be interviewed due to their limited communication abilities. The incident occurred in the safe, secure unit of the facility. The resident who entered the other resident?s room was in the safe, secure unit for approximately 24 hours. The incident occurred at approximately 3:00 AM. The room did have a locking system on the door, but the resident does not need to enter a code or use a key to exit the room, allowing the resident to unlock the door by themselves. The facility has a video surveillance system that recorded one resident entering another resident?s room. There were no cameras in the resident?s room. The next time the residents were seen on the cameras was when the resident who occupied the room was seen dragging the other resident out of their room. The administrator stated the video monitoring system is used as a retroactive tool and is not continually monitored. A review of the staffing schedule at the time of the incident shows the facility had the required staff to resident ratio at the time of the incident. The evidence gathered during the investigation did not support the allegation(s) of non-compliance with standard(s) or law. The aggressive resident approached another resident and invaded their space, resulting in the resident whose space was violated physically pushing the hand of the other resident away. Neither resident was injured.This was the second incident in less than a 24-hour period when the aggressive resident got into an altercation with another resident. This aggressive resident was sent to an area hospital for evaluation and treatment and their appropriateness for placement was evaluated. A review of the staffing schedule at the time of the incident shows the facility had the required staff to resident ratio at the time of the incident. The evidence gathered during the investigation did not support the allegation(s) of non-compliance with standard(s) or law. Type of inspection: Complaint Date(s) of inspection and time the licensing inspector was on-site at the facility for each day of the inspection: An on-site inspection related to a complaint was conducted on November 18, 2025. The Acknowledgement of Inspection form was signed and left at the facility for each date of the inspection. A complaint was received by VDSS Division of Licensing on October 21, 2025, regarding allegations in the area(s) of: RESIDENT CARE AND RELATED SERVICES Number of resident records reviewed: 1 Number of interviews conducted with residents: 1 Number of interviews conducted with staff: 1 Additional Comments/Discussion: During the course of the investigation, it was learned that the residents? service plan was not followed in the days leading to the resident?s injury. Specifically, the residents? service plan specifies that the resident is to be transferred by two staff. The evidence gathered during the investigation did not support the allegation(s) of non-compliance with standard(s) or law. However, violation(s) not related to the complaint(s) but identified during the course of the investigation can be found on the violation notice. The licensee has the opportunity to submit a plan of correction to indicate how the cited violation(s) will be addressed in order to return the facility to compliance and maintain future compliance with applicable standard(s) or law. If the licensee wishes to provide a plan of correction: (i) type the plan on a separate Word document, (ii) identify the standard violation number being addressed, (iii) include the date the violation will be corrected, (IV) do not include any names or confidential information, and (V) return to the licensing inspector by email within five (5) business days of the exit interview. Compliance with all applicable regulations and law shall be maintained and any areas of noncompliance must be corrected. Within 15 calendar days of your receipt of the inspection findings (inspection summary, violation notice, and supplemental information), you may request a review and discussion of these findings with the inspector's immediate supervisor. To make a request for review and discussion, you must contact the licensing supervisor at the regional licensing office that serves your geographical area. Regardless of whether a supervisory review has been requested, the results of the inspection will be posted to the DSS public website within 5 business days of your receipt of the Inspection Summary and/ or Violation Notice. Based on a review of documentation and interviews, the facility did not ensure that the care and services specified in the individualized service plan for resident #1 were provided. Evidence: 1) A review of the service plan for resident #1, dated October 30, 2025, notes that resident #1 required a ?2 person assist for all transfers?. 2) During the interview with staff #1, they informed the licensing inspector that between 4:00 PM on October 16th, 2025, and 6:00 AM on October 17th, 2025, resident #1 was not transferred via 2 staff as specified in the service plan for resident #1.
