A relicensure survey with complaint #CO33240 was completed on 11/15/23. No deficiencies were cited. THIS PORTION OF THE REPORT IS FOR INFORMATIONAL PURPOSES ONLY.No response is necessary.The residence was advised it must review and maintain the following processes in accordance with existing program regulations found at 6 CCR 1011-1, Chapter 7.22.35 Assisted living residences shall comply with the Colorado Clean Indoor Air Act at Sections 25-14-201 through 25-14-209, C.R.S.

A licensure complaint, prompted by #CO32721, was completed on 7/18/23. A deficiency was cited. Based on observation, record review, and interview the residence failed to ensure residents had the right to make decisions and choices regarding the management of their personal property in accordance with resident ability, affecting one of two sample residents (#2).Findings include:1. Residence PolicyThe residence' s undated Consumer Bill of Rights read in part that residents had the right to make decisions and choices in the management of personal affairs and property, in accordance with their abilities.2. Record ReviewAn undated document in the resident record for Resident #2, and signed by the resident, read: "I, (Resident #2), give permission for staff to keep my cigarettes in the office . I also give staff permission to give me one cigarette every two hours at times 7:00 a.m., 9:00 a.m., 11:00 a.m., 1:00 p.m., 3:00 p.m., 5:00 p.m., 7:00 p.m., and 9:00 p.m. This is to help me so I can budget how much (money) I spend on cigarettes."Progress notes, dated 5/1/23 to 7/17/23, read in part the following:5/1/23: "(Resident #2) vacuumed the common areas in the house in order to earn an extra cigarette. Mark did well; this task took (him) approximately 20 minutes."6/5/23: "(Resident #2) did hound staff to complete a chore right after his 3:00 p.m. cigarette. He then waited until after his 5:00 p.m. cigarette to ask for the chore cigarette."7/4/23: "Assist tobacco management: Not asking others but (was) hounding staff all evening for extras."7/5/23: "(Resident #2) asked staff for an extra cigarette in exchange for completing a chore."7/10/23:"(Resident #2) really hounded staff most of the afternoon for a chore cigarette. Staff gave (Resident #2) the chore and cigarette at 6:00 p.m."7/11/23: "Staff asked (Resident #2) to wait until after 6:00 p.m. to talk about doing a chore for an extra cigarette. (Resident #2) then began asking staff repeatedly about it while staff was attempting to cook, supervise his peer who was assisting to cook, and administering medications.
