Based on record review and staff interview the facility failed to ensure that an employee is not employed if the criminal history report contains convictions of the barrier crimes. Evidence: 1. A complaint received by the regional licensing office stated staff 2 had a conviction of a barrier crime and continued to be employed by the facility. 2. Following record review for staff 2 hired 8/9/2024, the criminal history report obtained 8/26/2024, confirmed a conviction of a barrier crime dated 6/30/2020. 3. During an interview on 10/04/2024, staff 1 stated that the standards indicate that an employee can be hired if convicted of 1 misdemeanor barrier crime if 5 years had passed since the conviction.
