A certification revisit was completed on 7/16/25 for the previous deficiency cited on 12/31/24. A deficiency was cited. The regulations governing Home and Community-Based Services were revised and the new regulations were implemented on 2/15/25. Tag B140 was not cited in the previous event; however, the deficiency was included in the previous event' s informational 999 tag. Based on interview and record reviews, the facility (residence) failed to ensure a lease, residency agreement, or other written agreement was in place for each member (resident), and specified rent or room and board charges, affecting five of seven sample residents (#2, #3, #5, #9, #10) and one former resident (#11). Findings include: The record for Resident #3 revealed there was no resident agreement in place.The records for Residents #2, #5, #9, #10, and former Resident #11 revealed resident agreements were signed on 9/19/19, 7/1/19, 6/24/25, 6/11/25 and 7/1/21, respectively. However, the above resident agreements failed to include the room, board, or rent amount; instead, the agreements read to "see (external service provider) housing sheet," which was not provided.On 7/16/25 at 11:39 a.m., the administrator designee stated she was unaware of the requirement for a resident agreement to be in place for all residents that specified rent, room, and board charges. She further stated she was unsure why the deficiency had not been addressed, since it was brought to the administrator' s attention in the previous event.
