The following deficiencies were found during the on-site compliance inspection and investigation of complaints 00146255, 00146194, 00137790, 00136211, 00136035, 00134036, 00125337, 00124924, 00108653, 00107234, 00105489, and 00104546 conducted on December 15, 2025:

Based on documentation review and interview, the manager failed to ensure that a resident was not subjected to the misappropriation of personal and private property by the assisted living facility's caregivers, employees, or volunteers for two of the five residents sampled. The deficient practice posed a risk if residents' property was misappropriated. Findings include: 1. A review of facility documentation revealed an incident and investigation report dated July 3, 2025, which stated that "E5 accepted money from a resident and it is a violation of company policy". 2. A review of facility documentation revealed an incident and investigation report dated October 6, 2024. Which stated “on Sunday, October 6, 2024, E5, Health Services Director, and executive director were made aware that E6 personally wrote personal information of E6 and the E6 spouse, including names, address, date of birth, and social security number, on a Prudential Financial document, making E6 and E6 spouse the new beneficiaries of resident’s annuity” A staff found this document after R5 passed. E6 was put on immediate suspension. On October 10, 2024, E6 was terminated”. 3. In an interview, E1 acknowledged that a resident was subjected to misappropriation of personal and private property by an employee of the assisted living facility.

The deficient practice posed a risk of protected and sensitive resident health information being disclosed without the resident's consent or knowledge. Findings include: 1. A.R.S. § 12-2291(6) "Medical records" means all communications related to a patient's physical or mental health or condition that are recorded in any form or medium and that are maintained for purposes of patient diagnosis or treatment, including medical records that are prepared by a health care provider or by other providers. 2. In an interview, E1 reported that E1 knew about E5's daughter labeling medication. 3. In an interview, E1 acknowledged that resident medical records were not protected from loss, damage, and unauthorized use.
