The following deficiency was found during the on-site investigation of complaints AZ00211344 and AZ00211392 conducted on June 6, 2024:

Based on documentation review, record review, and interview, after the administrator had a reasonable basis, according to A.R.S. \'a7\'a7 13-3620 or 46-454, to believe that abuse, neglect, or exploitation has occurred on the premises or while a resident is receiving services from a nursing-supported group home's employee or personnel member, an administrator shall, take immediate action to stop the suspected abuse, neglect, or exploitation, and report the suspected abuse, neglect, or exploitation of the resident as follows for a resident under 18 years of age, according to A.R.S. \'a7 13-3620. The deficient practice posed a potential residents rights violation if R1 was subjected to abuse. Findings include: 1. A review of department documentation revealed a report was made on June 5, 2024, involving suspected abuse allegations involving R1. These allegations were made while R1 was at the Tucson Medical Center against an employee at Jady Guardian. 2. During an interview, the Compliance Officers asked E1 about these allegations. E1 reported R1 ask to see E1 and made the same allegations on June 5, 2024. 3. A review of documentation provided by E1 revealed E1 immediately started the investigation of these allegations. However, E1 did not report the suspected abuse of R1 as required according to A.R.S. \'a7 13-3620. E1 reported the allegations were against E2. E1 put E2 on administrative leave until the investigation is completed. 4. A review of documentation titled "Neglect and Abuse" revealed "Vendor indicates that all staff are mandatory reporters and must report abuse and neglect to DCS or APS. Timelines for Reporting: The observer shall make initial reports immediately to a police officer or local adult protective services worker". 5. In an interview, E1 acknowledged not notifying DCS/APS or the police of the abuse allegations.
