A relicensure survey was completed on 11/21/23. A deficiency was cited. Based on record review, observation, and interview, the residence failed to ensure the resident' s rights to privacy, affecting three of four sample residents (#2, #3, #4).Findings include: 1. Reference and Residence PolicyAccording to Dictionary,com. Privacy is defined as: "The state of being apart from other people or concealed from their view; solitude; seclusion. The state of being free from unwanted or undue intrusion or disturbance in one' s private life or affairs." Dictionary.com (2023), retrieved from: https://www.dictionary.com/browse/privacy?s=tThe undated residents' Resident Rights policy read in part that residents had the right to reasonable privacy.2. ObservationsOn 11/21/23 at 7:15 a.m., a residence tour was conducted. The residence had four individual surveillance cameras/audio monitors audio and video surveillance cameras in a shared space linking the kitchen, dining room, and common living room. Three of the four monitors were activated. Resident #2 was in his bed in his room, and Resident #3 was in his bed in his room. Resident #2 and Resident #3 were seen and heard in each of their respective rooms. The monitor for Resident #4 was activated, but she was not in her room. On 11/21/23 at 7:20 a.m., Resident #3 was observed on the monitor as he arranged himself on the side of his bed in his room. Resident #4 was observed in the dining room and in the same proximity as the monitors. Resident #4 would have had access to camera monitors of two residents in their beds if she walked into the kitchen. On 11/21/23 at approximately 8:10 a.m., Residents #3 and #4 were observed at the dining table, while cameras on the kitchen shelf allowed visibility if they stood up and walked around. Resident #2 was observed on the monitor moving around in his bed and heard talking in his room. Resident #4' s dog was in the resident' s room and could be heard barking through the monitor.
