THIS PORTION OF THE REPORT IS FOR INFORMATIONAL PURPOSES ONLY.No response is necessary.The residence was advised it must review and maintain the following processes in accordance with existing program regulations found at 10 CCR 2505-10 8.400.8.484.4.A Provider-Owned or -Controlled Residential Settings must have all of the following qualities and protect all of the following individual rights, based on the needs of the individual as indicated in their Person-Centered Support Plan, subject to the Rights Modification process in Section 8.484.5:1. The unit or dwelling is a specific physical place that can be owned, rented, or occupied under a legally enforceable agreement by the individual, and the individual has, at a minimum, the same responsibilities and protections from eviction that tenants have under the landlord/tenant law of the State, county, city, or other designated entity. For settings in which landlord/tenant laws do not apply, a lease, residency agreement, or other form of written agreement must be in place for each individual, and the document must provide protections that address eviction processes and appeals comparable to those provided under the jurisdiction ' s landlord/tenant law.a. THIS PORTION OF THE REPORT IS FOR INFORMATIONAL PURPOSES ONLY.No response is necessary.The residence was advised it must review and maintain the following processes in accordance with existing program regulations found at 6 CCR 1011-1, Chapter 7.6.6 An administrator training program shall meet all of the following requirements:(A) The program or program components are conducted by an accredited college, university, or vocational school; or an organization, association, corporation, group, or agency with specific expertise in the provision of residential care and services; and(B) The curriculum includes at least 40 actual hours, 20 of which shall focus on applicable state regulations. A certification revisit was completed on 2/20/23 for the previous deficiency cited on 9/26/22. A deficiency was cited. Based on record review and interview, the facility (residence) failed to comply with written policies and procedures for the administration of medication in accordance with 6 CCR 1011-1, Chapter VII, affecting one of four sample participants (residents) (#6).This deficiency was cited previously during a recertification survey on 9/26/22. Although the facility corrected the deficiency, based on the findings below, the facility has not maintained compliance with this regulatory requirement.Findings include:1. Chapter VII regulations governing assisted living residences, part 14.21, requires that the assisted living residence shall be responsible for complying with authorized practitioner orders associated with medication administration except for those medications which a resident self-administers.a. Residence PolicyThe residence' s Medication and Medication Administration policy, dated July 2018, read,in part, "The assisted living residence is responsible for complying with authorized practitioner orders associated with medication administration except for those medication which a resident self-administers."b. Resident #6 was admitted to the residence on 12/6/17 with diagnoses including mood disorder and anxiety. A written practitioner' s order, dated 1/31/23, directed the residence to administer nuedexta 20-10 mg twice daily. However, the February 2023 electronic medication administration record for Resident #6 read the medication was not available and not administered from 2/1-2/20/23, for a total of 19 missed doses.c. InterviewsOn 2/20/23 at 7:35 a.m., Staff #6 stated the nuedexta medication for Resident #6 was out of stock and not administered on 2/20/23 for the morning dose. On 2/20/23 at 11:30 a.m., the administrator stated she expected staff to administer residents medications as ordered and not run out of stock. She added she was aware of the nuedexta being out for Resident #6 since 2/1/23 and had been working with multiple practitioner' s and the pharmacy to rectify the issue.
