Based on documentation review, observation and interview, a person maintained a health care institution without holding a current and valid license issued by the Department. Findings include: A.R.S. \'a7 36-424(C) On a determination by the director that there is reasonable cause to believe a health care institution is not adhering to the licensing requirements of this chapter, the director and any duly designated employee or agent of the director, including county health representatives and county or municipal fire inspectors, consistent with standard medical practices, may enter on and into the premises of any health care institution that is licensed or required to be licensed pursuant to this chapter at any reasonable time for the purpose of determining the state of compliance with this chapter, the rules adopted pursuant to this chapter and local fire ordinances or rules... If an inspection reveals that the health care institution is not adhering to the licensing requirements established pursuant to this chapter, the director may take action authorized by this chapter... A.R.S. \'a7 36-430 The operation or maintenance of a health care institution which does not hold a current and valid license or which exceeds the range of the services authorized by the class or subclass for which it is licensed is a violation of this chapter and is declared a nuisance inimical to the public health and safety. The director, in the name of the people of the state, through the attorney general, may bring an action for an injunction to restrain such violation or to enjoin the future operation or maintenance of any such health care institution until substantial compliance with the provisions of this chapter and the rules and regulations and standards adopted pursuant thereto is obtained. 1. A review of Department documentation revealed a complaint received on December 2, 2022, in which E2 reported E2 would surrender the license to operate AL11970, however, E2 reported E2 would not discharge the residents of the facility. 2. A review of Department documentation on Jnauary 13, 2025 revealed the property located at 7552 East 41st Street, Yuma AZ, 85365, was not licensed by the Department. 3. A review of Department documentation revealed the prior license at 7552 East 41st Street, Yuma AZ, 85365, LTC304, was closed on August 12, 2024. 4. A review of Department documentation revealed an application for an assisted living facility license at 4762 East Adams Street was received on December 2, 2022 and a denial letter was sent to the applicant on December 20, 2022. The denial letter included notice to the applicant of a 30 day appeal period for the Department decision to deny the application. However, notification of an appeal was not received by the Department. 5. A review of Department documentation revealed no pending applications, appeals, or other ongoing processes regarding 4762 East Adams Street except the complaint regarding unlicensed operation. 6. Upon arrival to the facility at approximately 10:33 AM, the Compliance Officer observed a posting in the front window which stated, "Harmony Hospice: Notice Oxygen In Use." The Compliance Officer rang the doorbell and E1 came to the door. The Compliance Officer observed E1 was wearing scrubs. 7. In an interview, E1 reported E1 was the caregiver for the facility. The Compliance Officer explained the reason for the on-site inspection and was invited into the facility. E1 reported there were six residents at the facility. E1 asked if they should call E2 to let E2 know about the inspection and proceeded to do so. 8. The Compliance Officer observed R1 was sitting in a wheelchair in the front living room. The Compliance Officer observed R1 was sitting on the sling from a Hoyer lift. The Compliance Officer observed a bedroom located to the east of the living room contained a folded up blue pad, an oxygen concentrator, a Hoyer lift, and a stack of disposable incontinence bed pads. 9. The Compliance Officer attempted to speak with R1, however, R1 did not respond to the Compliance Officer. 10. The Compliance Officer observed two residents, R2, and R3 sitting near a table in the dining room. Both residents were in wheelchairs. The Compliance Officer observed R2 had a catheter bag hanging off of the arm of the the wheelchair. 10. The Compliance Officer observed a sign posted on a bedroom door. The sign stated, "Please help feed and give [R4] food and liquids. [R4] is not strong enough for this. Thank you. [R4] has a pendant [R4] wears for help. The sound goes off from kitchen. Please help if you hear it. Thank you." 11. The Compliance Officer observed a bulletin board on the rear wall in the dining room by a sliding glass door. Posted on the bulletin board was a document titled, "Resident Rights," which stated, "As someone living in an assisted living facility, you have the right to be treated with respect and dignity and the right to make choices

A review of Department documentation on January 13, 2025 revealed the property located at 7552 East 41st Street, Yuma AZ, 85365, was not licensed by the Department. 3. A review of Department documentation revealed the prior license at 7552 East 41st Street, Yuma AZ, 85365, LTC304, was closed on August 12, 2024. 4. A review of Department documentation revealed an application for a nursing supported group home at 7552 East 41st Street, Yuma AZ, 85365 was received on November 6, 2024 and was still pending approval at the time of the on-site inspection. 5. Upon arrival to the facility at approximately 11:25 AM, the Compliance Officers observed a resident, R1, being transported from the facility in a facility van. The Compliance Officers observed the resident returned to the facility a few hours later and was present during the rest of the on-site inspection. 6. In an interview, E3 reported the facility had one resident. E3 reported R1 required two staff members to be present with the resident at all tim
