An on-site investigation of complaint 00161894 was conducted on February 3, 2026. The allegation that a person shall not establish, conduct or maintain in this state a health care institution or any class or subclass of health care institution unless that person holds a current and valid license issued by the department specifying the class or subclass of health care institution the person is establishing, conducting or maintaining, per A.R.S. § 36-407(A) was substantiated and the following deficiency was cited:

Based on documentation review, observation, record review, and interview, a person shall not establish, conduct or maintain in this state a health care institution or any class or subclass of health care institution unless that person holds a current and valid license issued by the department specifying the class or subclass of health care institution the person is establishing, conducting or maintaining. The deficient practice posed a risk if the facility was unable to meet a resident's needs. Findings include: 1. A review of the Department documentation revealed the following: An application for the directed level of care with a capacity of 10 residents. A license with the expiration date of December 12, 2025. 2. During an initial inspection of the facility with E1, the Compliance Officers observed the following: Six residents and two caregivers on-site. A caregiver assisting a resident in the restroom. Medication in a locked cabinet. 3. A review of R1’s medical record revealed a current service plan dated December 1, 2025. The service plan indicated R1 received medication administration and assistance with activities of daily living. 4. In an interview, E1 reported that the facility’s license had expired. E1 reported that E1 did not want to move the residents out while E1 obtained the facility's new license. E1 reported that the facility continued to provide care to the residents without a license. 5. In an exit interview, the findings were reviewed with E1, and no additional information was provided.
