Based on observation and interview, the manager failed to designate, in writing, a caregiver who was present on the facility's premises and accountable for the facility when the manager was not present, as the manager's designee. The deficient practice posed a risk as no individual was designated to act on behalf of the governing authority in the onsite management of the assisted living facility. Findings include: 1. Upon arrival at the facility at 9:30 AM, the compliance officer was greeted by E3. The Compliance Officer observed E3 and E2 were the only personnel members on the premises. 2. E1 arrived at the facility at approximately 9:50 AM. In an interview, E1 reported E4 and E5 were designated, in writing, to be present on the facility's premises and accountable for the facility when E1 was not present, as the manager's designee. 3. A documentation review revealed a document titled, "Delegation of Manager's Authority." The document was dated August 16, 2021, and stated, "In the absence of the manager, E4 trained caregiver is empowered to act on the Manager's behalf in directing and supervising the operation of this Assisted Living Facility and providing care to the residents..." 4. A documentation review revealed a document titled, "Delegation of Manager's Authority." The document was dated August 16, 2021, and stated, "In the absence of the manager, E5 trained caregiver is empowered to act on the Manager's behalf in directing and supervising the operation of this Assisted Living Facility and providing care to the residents..." 5. In an interview, E1 acknowledged there was no caregiver present on the facility's premises and was accountable for the facility when the manager was not present, as the manager's designee.
